Terms of Service

These Terms of Service ("Terms") govern your use of the DivePlanner Pro platform operated by Carbon Intelligence SAS. By accessing or using the platform, you agree to be bound by these Terms. If you do not agree, please do not use the platform.
1. Definitions
- "Platform": the DivePlanner Pro web application accessible at https://diveplannerpro.com and any associated services.
- "Publisher": Carbon Intelligence SAS, 29 rue Dussoubs, 75002 Paris, France (SIRET: 101 251 155 000 12).
- "Dive Center": a professional entity registered on the Platform to manage dive trips, bookings, and payments.
- "Diver": an individual who uses the Platform to browse, book, or participate in dive trips.
- "Booking": a reservation made by a Diver for a dive trip offered by a Dive Center through the Platform.
2. Description of Service
DivePlanner Pro is a software-as-a-service (SaaS) platform that provides dive centers with tools for managing dive trips, bookings, payments, equipment, staff, accommodation, and client relationships. The Platform also allows divers to discover dive centers, book trips, and manage their diving profiles.
3. Account Registration
To use certain features of the Platform, you must create an account by providing accurate and complete information. You may register as a Diver or as a Dive Center owner/staff member.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period. You may delete your account at any time through your account settings.
4. Terms for Dive Centers
Dive Centers may use the Platform to list dive trips, manage bookings, and accept payments. Subscription terms and pricing are available on the Platform and may be updated from time to time.
Dive Centers are solely responsible for the accuracy of their listings, the safety of their dive operations, compliance with local regulations, and holding appropriate insurance and certifications.
By listing content on the Platform, Dive Centers grant us a non-exclusive, worldwide license to display that content on the Platform for the purpose of operating the service.
5. Terms for Divers
When booking a dive trip, Divers enter into a direct contractual relationship with the Dive Center operating the trip. The Platform acts as an intermediary facilitating the booking and payment process.
Divers must hold valid certifications appropriate for the dive trips they book. Dive Centers may refuse participation if certification requirements are not met. Providing false certification information is grounds for immediate account termination.
Divers are responsible for ensuring they are medically fit to dive, for reviewing trip details before booking, and for complying with the Dive Center's rules and safety procedures.
6. Payments
All online payments are processed securely through Stripe, a PCI DSS Level 1 certified payment processor. The Platform does not store credit card numbers.
A platform commission of 3% is applied to online transactions processed through the Platform. This commission is deducted from the payment before it reaches the Dive Center's Stripe account.
The Platform supports multiple currencies including EUR, USD, IDR, THB, GBP, and AUD. The currency is set by each Dive Center.
Dive Centers may also record offline payments (cash, bank transfer, on-site card payments) through the Platform's management interface.
7. Cancellation and Refunds
Each Dive Center configures its own cancellation policy on the Platform. Divers should review the cancellation policy of each Dive Center before booking.
The default cancellation policy is: full refund if cancelled more than 48 hours before departure, partial refund if cancelled between 24 and 48 hours before departure, no refund if cancelled less than 24 hours before departure.
Refunds for online payments are processed through Stripe and may take 5-10 business days to appear on your statement. The Platform facilitates the refund process but the Dive Center is responsible for approving refunds in accordance with their policy.
8. Intellectual Property
The Platform, including its design, code, features, trademarks, and content created by the Publisher, is the intellectual property of Carbon Intelligence SAS and is protected by French and international intellectual property laws. DivePlanner Pro is a registered trademark (INPI No. 5216854). You may not reproduce, distribute, or create derivative works from the Platform without our prior written consent.
9. Limitation of Liability
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Carbon Intelligence SAS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim shall not exceed the amount of fees paid by you to us in the 12 months preceding the claim. The Platform is not responsible for the quality, safety, or legality of dive trips offered by Dive Centers.
10. Indemnification
You agree to indemnify and hold harmless Carbon Intelligence SAS, its directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.
11. Service Availability
We strive to maintain the Platform available 24/7, but we do not guarantee uninterrupted or error-free access. We may perform scheduled maintenance, updates, or modifications that may temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from or relating to these Terms or your use of the Platform shall be submitted to the exclusive jurisdiction of the Tribunal de Commerce de Paris, France.
13. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email at least 30 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
